Terms & Conditions

FewCookies — https://fewcookies.com/

These Terms & Conditions govern the use of this website and the contractual relationship between the seller and the customer for orders placed online. The document complies with Romanian law applicable to e-commerce and consumer protection, in particular Emergency Ordinance 34/2014 on consumer rights in contracts concluded with traders, Emergency Ordinance 140/2021 on the conformity of goods, and Law 365/2002 on electronic commerce.

1. General provisions and acceptance of terms

By accessing the website and/or placing an order, you confirm that you have read, understood, and agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website. Accepting the terms when placing an order constitutes a distance contract concluded between you and the seller.

2. Definitions

3. Seller identity

The products and services on this website are sold by:

Company: LUCKY SMART SYSTEMS SRL

Registration code (CUI/VAT): 24688650

Trade Register no.: j03/2250/2008

Registered office: Pitesti, ARGES

Email: [email protected]

4. Products, prices, and availability

The essential characteristics of the products are presented on each product’s dedicated page. Prices are expressed in Romanian lei (RON) and include VAT in accordance with applicable law. The Seller reserves the right to change prices without prior notice; the price applicable to an order is the one displayed when the order is placed. Product images are illustrative and may differ from the product delivered. In the event of obvious pricing errors or stock unavailability, the Seller will inform the Customer and may cancel the order with a full refund of amounts paid.

5. Placing and confirming an order

An order is placed by following the steps below, and the contract is considered concluded when the Customer receives confirmation of dispatch from the Seller:

  1. selecting products and adding them to the cart;
  2. entering delivery and billing details;
  3. choosing the payment and delivery method;
  4. reviewing and submitting the order;
  5. receiving an email confirming that the order has been registered.

6. Payment methods

Depending on the options available at checkout, payment can be made by bank card (online, through the secure payment processor), by bank transfer, or cash on delivery. Card payments are processed through an authorised provider in a secure environment; the Seller does not store your full card details. The invoice is issued electronically and sent to the Customer.

7. Delivery

Products are delivered by courier or by other means indicated at checkout, within the territory set by the Seller. The estimated delivery time is communicated when the order is placed. Delivery costs are shown separately before the order is confirmed and are borne by the Customer unless otherwise stated. The risk of loss or damage to the products passes to the Customer when they (or a third party designated by them, other than the carrier) take physical possession of the products. We recommend checking the integrity of the parcel on delivery.

8. Right of withdrawal (returns)

In accordance with Emergency Ordinance 34/2014, the Consumer has the right to withdraw from a distance contract, without having to justify the decision and without incurring costs other than return costs, within 14 calendar days. The period starts on the day the Consumer (or a third party designated by them) takes physical possession of the products.

To exercise the right of withdrawal, you may inform us by an unequivocal statement (for example, by email to the Seller’s contact address) before the 14-day period expires. You may use the model withdrawal form set out in the Annex to Emergency Ordinance 34/2014, but this is not mandatory. Returned products must be in the same condition in which they were received.

In the event of withdrawal, the Seller refunds all amounts received from the Consumer, including standard delivery costs, without undue delay and within no more than 14 days of being informed of the decision to withdraw. The refund is made using the same payment method used by the Consumer, unless otherwise agreed. The Seller may withhold the refund until the products are received back or until proof of return shipment is provided.

The right of withdrawal does not apply, under Article 16 of Emergency Ordinance 34/2014, among others, to:

9. Conformity and warranties

The Seller is liable for any lack of conformity of the products in accordance with Emergency Ordinance 140/2021 and applicable warranty law. The Consumer benefits from the legal guarantee of conformity and, where applicable, from the commercial guarantee offered by the manufacturer. In the case of a non-conforming product, the Consumer is entitled to repair or replacement of the product, a price reduction, or termination of the contract, under the conditions of the law.

10. Limitation of liability

The Seller cannot be held liable for indirect damage arising from the use of or inability to use the products, to the extent permitted by law. The Seller makes all reasonable efforts to keep the information on the website accurate and up to date but does not guarantee the absence of errors or service interruptions. Nothing in these terms limits the Consumer’s mandatory rights under consumer-protection legislation.

11. Intellectual property

The entire content of the website — text, images, graphics, logos, trademarks, and software — is the property of the Seller or its partners and is protected by copyright and industrial-property law. Reproduction, distribution, or use of the content for purposes other than those expressly permitted is prohibited without the prior written consent of the rights holder.

12. Processing of personal data

Personal data provided when placing an order is processed in accordance with Regulation (EU) 2016/679 (GDPR). Full details of the purposes, legal basis, and your rights are described in the Privacy Policy.

13. Dispute resolution (ANPC SOL / SAL)

15. Applicable law

These Terms & Conditions are governed by Romanian law. Any dispute is settled by the competent courts at the Seller’s registered office, without prejudice to the Consumer’s right to bring the matter before the court of their domicile, in accordance with consumer-protection legislation.
